1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you and ZuZuPal (“ZuZuPal,” “we,” “us,” or “our”) governing your access to www.zuzupal.com (the “Site”) and any purchase of products through the Site.
By browsing the Site, creating a cart, uploading photos, placing an order, or using our products, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or place an order.
Our Shipping Policy and Return Policy are incorporated into these Terms by reference.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to place an order. If you buy for a business, you represent that you have authority to bind that business.
You agree to provide accurate checkout information and to keep your email reachable for order and shipping updates.
3. The product
ZuZuPal sells custom optical acrylic chibi collectibles (including standees, charms, and related accessories) personalized from photos you upload. Product pages describe what’s included, display options (such as peg bases), and care guidance.
Artwork is generated through our controlled design pipeline and UV-printed / laser-cut onto acrylic. Previews are illustrative of style and composition; final printed colors can vary slightly due to screens, lighting, and manufacturing. We fulfill orders with products that meet or exceed the material functionality described at purchase.
Photo rights. By uploading an image, you represent that you own it or have permission to use it for a custom product, and that it does not infringe anyone’s rights or contain illegal content. We may refuse or cancel orders that appear to violate this rule and refund amounts charged where payment already occurred.
Not a licensed character brand. ZuZuPal creates personalized acrylic keepsakes from your photos. We do not sell official Funko®, Pop!®, or other third-party licensed vinyl figures unless expressly stated.
4. Orders, pricing & taxes
Prices are shown in the currency indicated at checkout (typically USD) and may change without notice before you complete payment. Displayed prices may exclude taxes, duties, or fees that apply to your order or destination; any such amounts will be shown at checkout or charged by your carrier/customs as applicable.
An order is an offer to buy. We accept the offer when payment is successfully authorized and we send an order confirmation email. We may refuse or cancel an order (and refund any amount charged) for reasons including production limits, pricing or listing errors, shipping restrictions, suspected fraud or abuse, rights issues with uploaded photos, or violation of these Terms.
Because products are personalized, production typically begins after payment confirmation. Promotional codes and cart incentives are subject to their stated rules and may be modified or ended at any time.
5. Payment
Payments are processed by Stripe and other payment partners we enable at checkout. By paying, you authorize the charge for your order total (including taxes and any paid add-ons such as shipping protection, if selected).
We do not store full payment card numbers on our servers. Card data is handled by our payment processor under their terms and security standards.
If a payment is reversed, charged back, or fails after fulfillment has begun, we may cancel, withhold, or recover the order as allowed by law.
6. Shipping, title & risk of loss
Shipping methods, timelines, and destinations are described in our Shipping Policy. Delivery dates are estimates, not guarantees. Customs delays, carrier issues, incorrect addresses, and force majeure events can affect delivery.
Unless otherwise required by law, title and risk of loss pass to you when we deliver the order to the carrier. You are responsible for providing a complete, accurate shipping address and for any duties or import taxes assessed on international shipments.
If you purchased optional shipping protection at checkout, coverage is limited to the protection described at purchase (for example, lost or damaged parcels) and is subject to any stated exclusions.
7. Returns, refunds & lost/damaged shipments
Returns and refunds are governed by our Return Policy. Except where non-waivable consumer law requires otherwise, ZuZuPal does not accept change-of-mind returns. Eligible claims are limited to products damaged on arrival or lost in transit.
You must contact us within seven (7) days of delivery (or the expected delivery window for losses) and provide the photo and video proof described in the Return Policy. Claims without timely notice or required proof may be denied. Starting a claim through Contact or the process on the Return Policy page is required for replacement or refund processing.
8. Limited warranty & disclaimer
Separately from transit damage claims under the Return Policy, we warrant that products will substantially conform to their product description at the time of sale and will be free from material manufacturing defects under normal display use for thirty (30) days from delivery, unless a longer period is required by law or stated in writing on the Site.
This limited warranty does not cover damage from shipping after a successful undamaged delivery (see Return Policy for transit claims), misuse, dropping, modification, neglect, accidents, or use contrary to care instructions. Because items are personalized from your photo, dissatisfaction with artistic style alone is not a defect.
Except for the limited warranty above, the Return Policy for lost/damaged shipments, and any non-waivable rights under law, the Site and products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Acceptable use
You agree not to: (a) use the Site for unlawful purposes; (b) upload unlawful, infringing, or abusive images; (c) attempt to gain unauthorized access to our systems; (d) scrape, crawl, or harvest the Site in a way that burdens our infrastructure or violates robots rules; (e) interfere with security or payment flows; (f) misuse promotional systems (including fake accounts or automated claims); or (g) reverse engineer product designs or Site software except where such restriction is prohibited by law.
10. Intellectual property
The Site, brand name, logos, product design, packaging, copy, photos, videos, and other content are owned by ZuZuPal or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or commercially exploit them without our prior written consent, except for limited personal, non-commercial use permitted by law (such as fair use).
11. Reviews & user content
If you submit reviews, photos, questions, or other content, you grant ZuZuPal a worldwide, non-exclusive, royalty-free license to use, display, and reproduce that content in connection with the Site and our marketing, with attribution where reasonable. You represent that you own or control the rights to what you submit and that it is truthful and not defamatory or unlawful. We may remove content at our discretion.
12. Third-party services
The Site relies on third parties (including payment, shipping, email, analytics, and advertising partners). Their services are subject to their own terms and privacy practices. We are not responsible for third-party sites or services we do not control.
13. Limitation of liability
To the fullest extent permitted by law, ZuZuPal and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or related to the Site, products, or these Terms, whether based in contract, tort, or otherwise—even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to an order or these Terms will not exceed the amount you paid to us for the product(s) giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted by law.
14. Indemnity
You agree to defend, indemnify, and hold harmless ZuZuPal from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or products, your violation of these Terms, or your violation of any third-party right—except to the extent caused by our willful misconduct or as prohibited by law.
15. Dispute resolution & governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except that mandatory consumer protection laws of your place of residence remain available to you where they cannot be waived.
Before filing a claim, you agree to contact us at hi@zuzupal.com and try to resolve the dispute informally for 30 days. If unresolved, disputes will be brought in state or federal courts located in Delaware, unless applicable consumer law requires otherwise. You and ZuZuPal consent to personal jurisdiction there.
Class action waiver. To the extent permitted by law, you and ZuZuPal agree to bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
16. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes apply prospectively. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms for future visits and orders. For completed orders, the Terms in effect at purchase generally continue to apply to that order.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms (including policies incorporated by reference) are the entire agreement between you and ZuZuPal regarding the Site and purchases, and supersede prior understandings on that subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
